Guidelines for the new responsible economic operator requirement
From 16 July 2021, Art. 4 of the Regulation (EU) 2019/1020 on market surveillance and compliance of products (hereinafter: “Market Surveillance Regulation”) will prevent distance sellers based outside of the EU from selling certain types of CE marked products (including toys and electrical goods) to customers in the EU where there is no EU-based economic operator responsible for compliance. These new rules have significant implications for sellers from Switzerland. In order to provide further clarifications on the practical implementation, the European Commission has published guidelines on the practical implementation of Art. 4 of the Market Surveillance Regulation.
