Adjustment of the processing fee for inspected defective products

The market surveillance authorities conduct retrospective and random inspections of products sold in Switzerland. If a product has been placed on the market although it is non-compliant because it has a safety defect – for example a gas grill posing an explosion risk – or lacking essential warnings and safety instructions, the responsible person will be obligated to pay an inspection fee.
The Federal Council has informed that by amending the Product Safety Ordinance, the fee, which has been in place since 2006, will be increased from CHF 200 to CHF 300 per hour. This aims to reinforce the principle that the generator is liable and pertains to the execution of a recommendation within the context of the 2027 relief package. Entities that introduce conforming products onto the market are unaffected by this modification.
