Extension of sanctions due to the situation in Ukraine and opening of the consultation process
On 28 February 2022, the Federal Council resolved to align with the European Union (EU) sanctions against Russia in response to the conflict in Ukraine, with the aim to strengthening their effect. In spring 2022, the Federal Council implemented the EU’s export and sales prohibitions on Russia for numerous categories of products pursuant to the Embargo Act, encompassing military equipment, items for civilian and military use, and goods intended for military and technological improvements.
Based on Article 184(3) of the Federal Constitution, the Federal Council has partially extended the restrictions in the military sector to Ukraine. The validity of such measures derived from Article 184(3) of the Constitution is confined to a maximum duration of four years, with the possibility of a single extension.
With the to maintain Switzerland’s neutrality commitments, the Federal Council has resolved to prolong these measures until 1 March 2030. Simultaneously, it has resolved to initiate a consultation process about a legal framework to supplant the emergency legal basis for these measures. The Federal Council’s press release states that this is solely a legal act with no substantive effect on the current sanctions. The consultation will last until 6 March 2026.
