In 2020, the U.S. Security and Exchange Commission (hereinafter “SEC”) brought eight corporate enforcement actions and collected approximately USD 683 million in those enforcement actions. A recently published post on FCPA Professor goes in-depth into various facts and figures relevant to SEC FCPA enforcement in 2020 and compares them with the SEC’s practice of the last years. In the view of the fact that the U.S. Congress amended the Securities and Exchange Act of 1934 codifying and expanding the power of the SEC, it might be that such comparisons will look different in the future.
